One, in particular, posted a lot of photos of employees who were all uniformly young (in their 30s and younger), energetic, and white.

The “Boy’s Club” Problem2022-03-22T20:19:10+00:002022-03-22T20:19:10+00:00https://wimlaw.com/articles/boys-club-problemKathleen J.
This topic came to me by way of a personal experience. It recently came to my attention that a male opposing counsel in a large litigation matter sent an invitation to join him and his trained dogs on a bird hunt. However, the invitation was sent only to the male members of our litigation team. Mind you, this is a lawyer who represents plaintiffs in employment matters; you’d think he’d know better. But the “boy’s club” mentality can be deeply ingrained. And if you have male managers at your company with the same mentality, you run the risk of losing qualified female workers or worse, drawing a sex discrimination lawsuit.

Dealing with An Employee’s Request for Leave As A Reasonable Accommodation2022-03-10T18:35:39+00:002022-03-10T18:35:39+00:00https://wimlaw.com/articles/employees-request-leave-accommodationKathleen J. What sets it apart from other anti-discrimination statutes is the requirement that an employer provides reasonable accommodation to an employee or job applicant with a disability, unless doing so would cause significant difficulty or expense for the employer. [Title VII does require some reasonable accommodations for persons with closely held religious beliefs, but the standard is slightly different.]

Specifically, the DOL announced that it will withdraw the COVID ETS, effective January 26, 2022. This comes after the U.S. Supreme Court stayed enforcement of the OSHA ETS on January 13, 2022, which guaranteed the ETS’ demise. Rest In Peace, ETS.

OSHA’s Enforcement of the OSHA COVID-19 Large Employer ETS Starts Today, 1/10. But Will the Supremes Put a Stop to It?2022-01-10T17:20:07+00:002022-01-10T17:20:07+00:00https://wimlaw.com/articles/osha-enforcement-covid-19Kathleen J. However, it will not issue citations for noncompliance with the standard’s testing requirements before February 9, so long as an employer is exercising reasonable, good faith efforts to come into compliance with the standard. What does the mean for employers with 100 or more employees? If OSHA shows up at your facility, it may ask to see the documentation showing your compliance with the ETS’ requirements for things such as a written vaccination policy and records of employee vaccination status. Alternatively, employees could complain to OSHA that that their employer is not following the OSHA ETS, which is probably the bigger danger right now. Such an employee complaint could trigger an OSHA complaint investigation, which no business wants.
